General Auction Rules

Horses Must Be Registered: 
All horses to be sold by auction must be registered with the Paso Fino Horse Association, Inc.

BIDDING: The highest, bidder as
determined by the Auctioneer will be the Buyer provided that the highest bid is at least the minimum sales price established by the Seller, if any If any dispute arises during bidding, the horse being auctioned will be put up for advanced bids. If there is no advanced bid, the buyer shall be the bidder from whom the Auctioneer recognized the last highest bid before the dispute arose. Bids shall advance only by amounts determined by the Auctioneer. The Auctioneer reserves the right to refuse any bid without cause and to cease the bidding on any horse.

PAYMENT AND SALE TERMS: Buyer shall pay for the horse immediately following acceptance of Buyer's bid. Buyer shall make full payment of the purchase price, and any additional charges due by Buyer, by cash, personal check, money order, cashier's check, travelers check or a combination of these methods Title to the horse, as evidenced by registration papers, will not be transferred to the Buyer until the purchase price, and any additional charges due by Buyer, have been received in full, i.e., until any and all checks have cleared for payment. Any additional fee due by Seller shall be paid immediately following acceptance of Buyer's bid. All horses are to be sold without any warranty whatsoever.

RISK OF LOSS: INSURANCE. Buyer assumes responsibility for the horse and risk of loss of the horse upon tendering payment of the purchase price. If the purchase price of the horse is paid other than completely in cash, Buyer and Seller will arrange for full mortality insurance effective upon acceptance of Buyer's bid in an amount 'lot less than the amount of the purchase price not paid in cash Buyer and Seller each shall pay 1/2 of the cost of the mortality insurance 'Which shall designate the Seller as joint loss payee up to the amount of the purchase price not paid in cash.

   






STALL FEE: TRANSPORTATION.
Seller shall pay the stall fee due for the horse. Buyer shall be responsible for transporting each horse purchased at the auction. Each horse shall be removed from the show grounds on or before Monday, May 28, 2001.

SELLER'S REMEDIES UPON BUYER'S DEFAULT. If buyer defaults in payment of any portion of the purchase price. Seller shall have available all remedies provided by law, including without limitation the right to repossession of the horse or to bring an action for specific performance. Buyer shall be responsible for all costs incurred by Seller to enforce Seller's rights, including court costs and reasonable attorney's fees.

GOVERNING LAW. Interpretation of these General Rules and resolution of any dispute concerning any aspect of the auction shall be accordance with the laws of the State of Florida.

AUCTION MANAGEMENT NOT RESPONSIBLE. While auction management will attempt to assure the accuracy of information presented, none of the Florida Paso Fino Horse Association, Inc., its officers and directors or the Auctioneer are responsible for errors or admissions. All persons participating in or attending the auction do so at their own risk and none of the Florida Paso Fino Horse Association. Inc., its officers and directors or the Auctioneer are responsible for accidents, injuries, or errors of any sort! that may occur in connection with the auction.

ADDITIONAL RULES. The management of the auction reserves the right to impose such other rules and procedures as it declares reasonably necessary to fairly conduct the auction.

 

 

Auction will be held in Show Arena on Sunday, May 27th, during lunch break


AUCTION FEES

1. Horses Consigned with no minimum price $150.00 registration Fee* 

2. Horses consigned with a reserve less than $10,000.00
                         
    $200.00 registration fee*


3. Horses consigned with a reserve $10,000.00 or more

    $300.00 registration fee* 

*All registration fees include stabling. 

The Auction shall be limited to ONLY 40 HORSES. Therefore, please fax

the horse's Certificate of Registration and send your check payable to

Florida PFHA for the appropriate amount as soon as possible. All entries

will be on a first come, first serve basis.
